Terms and conditions for the purchase and redemption of Delicard® gift cards

1. Scope and definitions

1.1. These terms and conditions apply to purchasing and redeeming of Delicard® gift cards (hereinafter "Gift Card") sold in the online store of Edenred Finland Oy (hereinafter "Edenred"). By purchasing a Gift Card or using a Gift Card, the customer accepts these terms and conditions at the time of purchase and at the time of use. These terms and conditions apply to new Gift Cards purchased from 10.11.2022 and redeemed as of this date.

1.2. Unless otherwise explicitly stated in these terms and conditions, customer means both a business or a consumer customer that acquires Gift Cards primarily for purposes other than their business, or a person who redeems a Gift Card they have received.

1.3. A customer who is a consumer and purchases Gift Cards must be a natural person of legal age, with legal capacity and residence in Finland.

3. Purchase and delivery of a Gift Card

3.1. The purchase of gift cards requires the customer to log in to the Edenred Delicard® online shop using its customer ID. The login can be done either with an existing customer ID or with a new customer ID created at the time of login.

3.2. The Gift Card purchaser can choose a Gift Card from the current range of Gift Cards offered by Edenred, which the purchaser can explore here. The purchaser also chooses whether the Gift Card includes one, two or three products.

3.3. The purchaser has the possibility to personalize the Gift Cards and add greetings to them as specified in the Delicard® online shop. Edenred reserves the right to charge an additional fee for personalization. Edenred indicates its current additional charges for personalization in the Delicard® online shop.

3.4. The purchaser chooses the delivery method of the Gift Card. The Gift Card can either be delivered as a physical Gift Card or an electronic eDelicard.

3.5. All Gift Cards offered by Edenred can be ordered to Finland. However, there are restrictions on ordering the food products included in the Gift Cards depending on the delivery address, which means that it is not possible to order food with the Gift Card to Åland and northernmost Finland.

3.6. In addition to Finland, Delicard® Nordic Design gift cards can be ordered to other EU countries, the UK, Switzerland and Norway.

3.7. The purchaser can choose to have all the ordered Gift Cards sent to the same postal address or to the same e-mail address, in which case the purchaser is responsible for delivering them to the gift recipients. Alternatively, the purchaser can choose to have the Gift Cards sent directly to the gift recipients’ e-mails or postal addresses provided by the purchaser.

3.8. Electronic Gift Cards will be sent to the recipient's e-mail address immediately after the order is placed or at a time specified by the purchaser. No delivery or billing fees will be charged for the delivery of electronic Gift Cards.

3.9. When the purchaser orders a physical Gift Card, the delivery method is by a postal letter, in which case the customer can request the delivery date to be the third working day after the order date, at the earliest. Edenred will do its best to comply with the delivery dates requested by the customer, but they are not binding on Edenred.

3.10. Edenred has the right to charge the customer a separate delivery fee for the delivery of physical Gift Cards. Edenred’s delivery fees in force at the time are stated in its online shop.

 

4. Payment methods

4.1. Gift Cards and their delivery charges are paid at the time of ordering. We generally accept the following payment methods: credit card, online banking.

4.2. In addition, our business customers can pay by invoice. However, this option is not available to Gift Card purchasers that are consumers.

4.3. Edenred reserves the right not to accept certain payment methods and, accordingly, to accept payments only from certain countries and/or to request you to use another payment method. If the customer pays by card, Edenred reserves the right to make an authorization hold at the time of order to secure the payment. The customer is responsible for the costs resulting from payment transactions.

4.4. By accepting these terms and conditions, the customer agrees that Edenred will send invoices and other supporting documents exclusively in electronic form.

4.5. Payments with Visa, Visa Electron or MasterCard cards

4.5.1. When paying with Visa, Visa Electron or MasterCard cards, the payment handling service provider and payment service provider is Swedbank Finland (1973378-1).

4.5.2. In this case, Swedbank acts as both the recipient of the payment and the seller of the product, in which case the transaction happens between Swedbank Finland and the customer. Once the payment has been received, Swedbank forwards the payment to Edenred.

4.5.3. Notwithstanding the above, Edenred is responsible for all obligations regarding the transaction.

4.6. Online banking

The payment handling service for online bank payments is provided by Swedbank Finland (1973378-1). From the user's point of view, the service works in the same way as traditional online payment.

5. Conclusion of a contract

The contract is concluded when Edenred has accepted the customer's order and the customer has received an order confirmation from Edenred. The right to use the Gift Card and the responsibility for careful safekeeping of the Gift Card shall pass to the purchaser of the Gift Card or the recipient of the Gift Card, depending on the delivery method, once Edenred has delivered the Gift Card to the purchaser or the recipient of the Gift Card.

 

6. Redeeming a Gift Card

6.1. The recipient of the Gift Card can redeem the Gift Card here. To redeem the Gift Card, the Gift Card number must be entered in the Delicard® online shop. The Gift Card recipient can then select the number of products or services determined on their Gift Card from the range of products and services specified on the Gift Card.

6.2. The Gift Card cannot be used only partially, as the recipient of the Gift Card must redeem all the products received with the Gift Card at the same time.

6.3. However, for a fee, the recipient of the Gift Card may also purchase products that are not included in the Gift Card when redeeming the Gift Card.

 

7. Products ordered with a Gift Card

7.1. Once the Gift Card recipient has selected the products they want, they must then provide the delivery address to which the products will be delivered and where the Gift Card recipient shall receive the products, or select a pick-up point where the Gift Card recipient will collect the products.

7.2. If the order does not include food products and the delivery address is in mainland Finland, the recipient of the Gift Card can choose to have the order delivered either directly to the delivery address or to a pick-up point used by the delivery company.

7.3. If the estimated delivery time to the delivery address provided by the recipient of the Gift Card is longer than 2 days, the Gift Card cannot be used to order food products.

7.4. Depending on the delivery location, the delivery time is 2-4 days from receipt of the order. The recipient of the Gift Card can check the first possible delivery dates to the provided delivery address at the time of redemption of the Gift Card.

7.5. Edenred is responsible for the delivery charges for products ordered with the Gift Card. If the recipient of the Gift Card orders products outside of mainland Finland, all customs documents, duties and taxes required for delivery are also included in the order. However, an exception to this is Åland, where the recipient is responsible for paying the customs duties and taxes on the products ordered.

7.6. The transport of products ordered with a Gift Card is the responsibility of the contract partner used by Edenred at the time, which is specified in the Delicard® online shop.

 

8. Services ordered with a Gift Card

8.1. If the recipient of the Gift Card has ordered services with his/her Gift Card, he/she must redeem the service by providing Edenred with an e-mail address to which Edenred can send the necessary voucher code to use the service.

8.2. The voucher code will be delivered to the e-mail address provided within one business day of redeeming the Gift Card.

8.3. Once the recipient of the Gift Card has received a voucher code, the activation of the service is done on each service provider's own website or app, where the recipient of the Gift Card enters the necessary information and the voucher code received from Edenred.

8.4. Services ordered with a Gift Card can only be redeemed through each service provider's own website or app. Access to the service is only available once the service provider has confirmed that the commissioning of the service has been successful.

8.5. The Services are subject to each provider's own terms of use, including possible cancellation terms. Edenred recommends that you familiarize yourself with these terms and conditions before redeeming the service. Edenred is not responsible for the services of the service providers and the terms and conditions applicable to them from time to time.

8.6. If technical or other similar problems arise in connection with the commissioning of the service, they should be reported directly to the respective service provider.

 

9. Validity period of the Gift Card

9.1. The validity period and last redemption date of the Gift Card is stated on each Gift Card. The validity period of the Gift Card varies depending on the type of Gift Card and the date of order. The Gift Card is valid for at least two (2) months from the date of order.

9.2. If the Gift Card recipient has ordered from Edenred a voucher code for activation of the service included in their Gift Card, but has not completed the activation of the service on the website or application of the service provider in question within the one (1) month validity period stated on the Gift Card, Edenred is not obliged to extend the validity of the Gift Card. In this case the Gift Card is considered redeemed.

9.3. The Gift Card recipient or purchaser has no right to claim compensation from Edenred if the Gift Card recipient has not redeemed their Gift Card during the validity period. Edenred has the right to invalidate the Gift Card if it suspects a misuse of the Gift Card.

 

10. Right of return, refunds and right of cancellation of the order

10.1. Edenred shall not be liable for Gift Cards lost, damaged or stolen after delivery and does not replace them with new Gift Cards.

10.2. Edenred also does not refund expired Gift Cards.

10.3. Gift Cards cannot be exchanged for cash.

10.4. A Gift Card purchaser who is a consumer has the right to cancel the purchase of a Gift Card in accordance with the Finnish Consumer Protection Act within fourteen (14) days of the receival of the Gift Card. Exercising the right of cancellation is only possible when the Gift Card has not been used.

10.5. The recipient of the Gift Card also has the right to cancel an order made with the Gift Card, if the order concerns other than food products, in accordance with the Finnish Consumer Protection Act within fourteen (14) days of receipt of the products ordered. However, there is no right of cancellation for health or hygiene reasons if the product has been opened.

10.6. If the recipient of the Gift Card exercises his/her right of cancellation, Edenred cannot exchange the Gift Card for money nor reactivate the Gift Card for reuse. Edenred shall only send a new Gift Card.

10.7. There is no need to state a reason for the cancellation.

10.8. The person exercising his/her right of cancellation must first contact Edenred's customer service. The contact details of the customer service are specified in Section 2 of these Terms and Conditions.

 

11. Exercising the right of cancellation

11.1. If the recipient of the Gift Card wishes to cancel an order made with the Gift Card, he/she must first notify Edenred’s customer service of the cancellation. The contact details of the customer service are specified in Section 2 of these Terms and Conditions. Such a notification can be made either directly by telephone or by using the cancellation form below or any other clear notification that informs of the decision to cancel the order, which will be sent to Edenred by e-mail or post.

11.2. When exercising his/her right of cancellation, the recipient of the Gift Card must inform Edenred customer service of his/her order number, the date of the order and which products are being returned. The recipient of the Gift Card will receive a return code and return instructions from Edenred customer service. The recipient of the Gift Card must use the return code provided and return the products in accordance with the instructions given.

11.3. CANCELLATION FORM

I declare that I wish to cancel the redemption of the Gift Card that I have made with the order number [insert order number] and which concerns the delivery of the following products:

11.4. If the cancellation notice has been sent by e-mail, Edenred will send an acknowledgment of receipt and instructions for returning the products without delay. The order is considered canceled within the set period, if the cancellation notice is sent before the cancellation period ends.

11.5. Edenred is not liable for the shipping costs of returning canceled products. In such case, the recipient of the Gift Card is responsible for the shipping costs.

11.6. The product to be returned must be delivered to Edenred without delay and no later than 14 days after the recipient of the Gift Card has notified Edenred of the cancellation of the order. All products must always be returned in accordance with the instructions given by customer service to the address provided by Edenred’s customer service. Products should not be returned to the address of the Edenred customer service.

11.7. The products are considered returned within the 14-day time period when the products have been left to be transported by the carrier chosen by the recipient of the Gift Card within that period, in accordance with the instructions provided by Edenred customer service.

11.8. To exercise the right of cancellation, the product to be returned must be in its original packaging and resellable, and there must be no traces of use on the product or its packaging. If the product to be returned is not packaged as instructed or is not in its original condition, Edenred has the right to refuse to compensate the redeemed Gift Card with a new Gift Card.

11.9. If the recipient of the Gift Card wishes to exchange an individual product he/she has ordered, he/she must first return the exchanged product to Edenred in the manner specified above in Sections 11.1.-11.8. When Edenred has received the exchanged product and checked that it has been sent in its original packaging and can be resold, Edenred will send the recipient of the Gift Card a new Gift Card to redeem a new product to replace the product exchanged. In this case, however, the recipient of the Gift Card is responsible for the shipping costs of returning the product to be exchanged and the shipping costs of sending the new product. On request, Edenred's customer service will inform the recipient of the Gift Card of the current shipping costs for sending the new product.

 

12. Product defect and complaints

12.1. Edenred is liable for defects in products ordered with a Gift Card in accordance with the applicable legislation in force at the time.

12.2. Upon receiving the delivery, the recipient of the Gift Card must check that the packaging received during delivery is free of defects. Visible defects in the packaging must be reported to the carrier's representative upon receipt of the delivery.

12.3. After receiving the delivery, the recipient of the Gift Card must check without delay that the delivery has included the Gift Cards or the products ordered with the Gift Card and that they are free of defects. If the recipient of the Gift Card discovers that the delivery or the product is defective, he/she must immediately notify Edenred's customer service of the defect upon discovery of the defect. The contact details of the customer service are specified in Section 2 of these Terms and Conditions.

12.4. Products for which a complaint is made must be stored until the complaint has been processed or returned to Edenred at Edenred's request.

12.5. The recipient of the Gift Card does not have the right to file a complaint for a product defect resulting from his/her failure to comply with the product-specific instructions for use and storage provided with each product’s package. It is also the responsibility of the recipient of the Gift Card to move the products to the appropriate storage facilities as soon as possible after delivery.

 

13. Liability for damages and maximum amount

Edenred is not liable for any direct or indirect damages caused to the customer. If the customer wishes to claim damages from Edenred, this must be claimed within two (2) months from the time when the defect on which the damages are based was discovered or should have been discovered or, in cases of delay, from the time when delivery has taken place.

 

14. Right to refuse a contractual relationship

Edenred has the right to refuse to enter into a contract for the sale of a Gift Card with a customer if it so wishes.

 

15. Transfer of contract

A party does not have the right to transfer the contract to a third party without the prior written consent of the other party. However, Edenred has the right to transfer the contract in whole or in part to a third party to whom the business referred to in the contract is transferred without the consent of the customer. Edenred also has the right to transfer its contractual claims under the contract to a third party. After notification of the transfer of claims, payments can only be made to the transferee.

 

16. Personal data

16.1. Ordering Delicard Gift Cards requires providing personal data to Edenred. Edenred processes personal data as described in its Privacy Notice.

16.2. The customer can use the rights described in more detail in our data protection policy, according to the EU General Data Protection Regulation, such as the right to inspect their own personal data. Additional information and contact details for exercising these rights are available in our Privacy Notice.

 

17. Force majeure

17.1. Edenred is not responsible for any delivery delays or other breaches of contractual obligations caused by force majeure.

17.2. Force majeure is considered to be an unusual event that affects the matter occurring after the conclusion of the contract, which is beyond Edenred's control and the effects of which Edenred cannot reasonably avoid or overcome. Such an event may be, for example, war, riot, or seizure for public necessity, interruption of energy supply, strike, fire, epidemic, pandemic, thunderstorm or other natural phenomenon or any other cause with similar and unusual cause independent of Edenred. If the fulfillment of the contractual obligation is delayed for any of the aforementioned reasons, the time for fulfillment of the contractual obligation shall be extended for as long as is reasonable taking into account all the circumstances affecting the case.

 

18. Changes to terms and conditions and rights of use

18.1. Edenred reserves the right, at its sole discretion, to make additions and changes to all or parts of these terms and conditions at any time without separate notice.

18.2. All changes to these terms and conditions will take effect on the effective date shown at the top of the terms and conditions. Purchasing Gift Cards after these Terms and Conditions have changed is interpreted as acceptance of those changes.

18.3. Edenred also has the right, without separate notice and without liability for compensation, to limit or cancel the use of its Delicard® online shop for Gift Cards, to remove parts of the online shop or to restrict the use of certain functions or services of the online shop in whole or in part.

 

19. Applicable law

These terms and conditions are governed by Finnish law, excluding its conflict of law provisions, unless otherwise provided by mandatory legislation in the customer's country of residence.

 

20. Dispute resolution

20.1. The Parties primarily seek to resolve any disputes arising out of these terms and conditions or their application through negotiations. If negotiations do not lead to an amicable solution, the disputes will be resolved in the District Court of Helsinki in Finland.

20.2. However, a customer who is a consumer can also take the dispute to a district court or other body dealing with consumer disputes in their place of residence. In Finland, such a body is the Consumer Disputes Board. Before taking the matter to a court or other consumer dispute resolution body, the customer is advised to contact the consumer advice center in their own country.
